En respuesta a esta nueva forma de organizaci\u00f3n laboral, la <span style=\"color: #33cccc;\"><strong>Secretar\u00eda del Trabajo y Previsi\u00f3n Social (STPS) <\/strong><\/span>public\u00f3 la<span style=\"color: #33cccc;\"> <strong>NOM-037-STPS-2023<\/strong><\/span>, una norma que ha generado muchas dudas, especialmente entre empleadores que buscan cumplir con la ley sin invadir la privacidad del trabajador.<\/span><\/p><p style=\"font-weight: 400;\"><span style=\"color: #000000;\">En esta entrada te respondemos las <span style=\"color: #33cccc;\"><strong>preguntas m\u00e1s data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p style=\"font-weight: 400;\"><span style=\"color: #000000;\">La norma define el <span style=\"color: #33cccc;\"><strong>teletrabajo<\/strong><\/span> como la <span style=\"color: #33cccc;\"><strong>realizaci\u00f3n de actividades remuneradas fuera del centro de trabajo<\/strong>,<\/span> utilizando tecnolog\u00edas de la informaci\u00f3n y comunicaci\u00f3n (TIC), como computadoras, tel\u00e9fonos m\u00f3viles, plataformas digitales, entre otros.<\/span><\/p><p style=\"font-weight: 400;\"><span style=\"color: #000000;\">El trabajo puede ser realizado <span style=\"color: #33cccc;\"><strong>desde casa o desde otro lugar fijo previamente acordado<\/strong><\/span> con el empleador.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-79bbdaac elementor-widget elementor-widget-heading\" data-id=\"79bbdaac\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">\u00bfA qui\u00e9n aplica la NOM-037?<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7c6d57e8 elementor-widget elementor-widget-text-editor\" data-id=\"7c6d57e8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p style=\"font-weight: 400;\"><span style=\"color: #000000;\">La NOM-037 <span style=\"color: #33cccc;\"><strong>aplica a todos los centros de trabajo<\/strong><\/span> que cuenten con <span style=\"color: #33cccc;\"><strong>personal que realice al menos el 40 % de su jornada semanal fuera del centro de trabajo<\/strong>.<\/span><\/span><\/p><p style=\"font-weight: 400;\"><span style=\"color: #000000;\">No aplica a esquemas ocasionales o espor\u00e1dicos, ni a quienes alternan entre oficina que la persona que teletrabaja cuente con condiciones <span style=\"color: #33cccc;\"><strong>seguras y saludables<\/strong><\/span>, tales como:<\/span><\/p><ul style=\"font-weight: 400;\"><li><span style=\"color: #000000;\">Un <span style=\"color: #33cccc;\"><strong>espacio ergon\u00f3mico<\/strong><\/span> (silla, mesa, iluminaci\u00f3n, ventilaci\u00f3n).<\/span><\/li><li><span style=\"color: #33cccc;\"><strong>Acceso a conectividad y equipos funcionales<\/strong>.<\/span><\/li><li><span style=\"color: #000000;\"><span style=\"color: #33cccc;\"><strong>Evaluaci\u00f3n de riesgos laborales<\/strong><\/span> en el lugar de trabajo remoto.<\/span><\/li><li><span style=\"color: #000000;\">Capacitaci\u00f3n en <span style=\"color: #33cccc;\"><strong>salud y seguridad en el teletrabajo<\/strong>.<\/span><\/span><\/li><li><span style=\"color: #000000;\"><span style=\"color: #33cccc;\"><strong>Pol\u00edtica de teletrabajo<\/strong><\/span> por escrito.<\/span><\/li><li><span style=\"color: #000000;\">Acuerdo por escrito con el trabajador que incluya las condiciones del trabajo a distancia.<\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-9c1432d elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"9c1432d\" data-element_type=\"section\" las empresas y a los trabajadores.<\/span><\/p><ul><li><span><strong style=\"font-weight: 400;\"><span style=\"color: #000000;\">\u00a0<span style=\"color: #33cccc;\">No, la norma no obliga a hacer visitas domiciliarias<\/span>.<\/span> <\/strong><\/span><span style=\"color: #000000;\">Sin embargo, <span style=\"color: #33cccc;\"><strong style=\"font-weight: 400;\">s\u00ed establece que debe evaluarse el lugar donde se realiza el teletrabajo<\/strong><\/span> para verificar que cumple con condiciones seguras.
